Bylaw A-10
Pursuant to
The Dental Association Act
The Manitoba Dental Association
A bylaw to provide for the registration of dental assistants with the Manitoba Dental Association (MDA).
Registration
1. In order to be registered as a dental assistant, an applicant must:
a) submit a completed application form (Schedule K) to the Registrar;
b) provide evidence satisfactory to the Registrar of qualifications hereinafter described in paragraph 2; and
c) pay the fee as determined by the Board of the MDA.
2. To qualify for registration, an applicant must provide satisfactory evidence that he/she:
a) is a graduate of an accredited dental assistant program on or before December 31, 2006. For the purpose of this Bylaw, an accredited dental assistant program is one that is accredited by either the Commission on Dental Accreditation of Canada ("CDAC") or the Commission on Dental Accreditation of the American Dental Association ("CODA/ADA"); or
b) is a graduate of an accredited dental assistant program after January 1, 2007 and possesses the National Dental Assistant Examining Board ("NDAEB") certificate; or
c) is a graduate of a non-accredited dental assistant program, possesses the NDAEB certificate and has passed the Clinical Practical Examination ("CPE").
Certificate of Registration
1. The Registrar shall provide a certificate of registration (Schedule L) to a dental assistant, who is registered with the MDA, and:
a) is in good standing;
b) pays the annual registration fee as determined by the Board of the MDA;
c) provides evidence that he/she is carrying professional liability insurance in the amount of not less than $1,000,000.00 per claim;
d) provides satisfactory evidence that any continuing education requirements prescribed by the Bylaws pursuant to Section 9(1)(k) of The Dental Association Act have been met;
e) provides satisfactory evidence of nine hundred (900) hours of clinical practice in the preceding three (3) years or a pro-rated portion thereof if the applicant has been registered for less than three (3) years;
f) has a current certificate from an appropriate resuscitation program as approved by Manitoba Health
2. A dental assistant, who does not meet the requirements for clinical practice described in paragraph 1(e), may be required by the Registrar to successfully complete examinations, a course of studies, or supervised practical technical experience.

Provisional Registration
A Bylaw to amend Bylaw A-06 to allow for the provisional registration and provisional certificate of registration for dental assistant graduates of formal dental assistant programs in Manitoba
The National Dental Assistant Examining Board, herein referred to as NDAEB, requires that dental assistants successfully complete a formal dental assistant education program in order to write the national board exam.
Further, the NDAEB has standardized national dates for writing the exam. Presently those exam dates are set for the months of March, June, September, and December.
Amendments to Bylaw A-06
Registration
3. Provisional Registration will be afforded to a dental assistant who has graduated from a formal dental assistant program in Manitoba and provides proof that they have registered to write the NDAEB exam.
a) The provisional registration will be in effect for 9 months from the time of provisional registration.
b) Upon successful completion and proof that they have successfully completed the NDAEB written exam thereof a dental assistant will be considered fully registered as per criteria in Registration 2(b).
Certificate of Registration
3. The Registrar shall provide a Provisional Certificate of Registration (Schedule N) to a dental assistant, who is granted provisional registration status as per Registration 3, who:
a) pays the annual registration fee as determined by the Board of the MDA;
b) provides evidence that he/she is carrying professional liability insurance in the amount of not less than $1,000,000.00 per claim;
c) Must work under the direct supervision of a dentist;
d) Provisional Certificate of Registration expires as per Registration 3a;
e) Upon proof of having successfully completed the NDAEB examination the dental assistant will be provided with a Certificate of Registration (Schedule M).

DENTAL ASSISTING
THE MANITOBA DENTAL ASSOCIATION
A By-law for the registration and certification fees to be paid by Registered Dental Assistants.

FEES TO BE PAID FOR . . .
1) Registration Certificate $25.00
2) Annual renewal of the Registration Certificate:
a) For a new graduate their first certificate, before September 1 st in their
year of graduation - $90.00
b) For a first certificate, but not a new graduate, after September 1 st ; - $90.00
c) For all others, including certificate paid in one payment; - $180.00
d) For certificate paid in two payments
April 30 - $90.00
September 15 - $90.00
Total $180.00
3) A 30-day grace period for the renewal of the Registration Certificate fee payment is hereby instituted. A penalty for late renewal payment will be $2.50/day until the certificate fee has been paid, to a maximum of $75.00. If the certificate renewal fee is unpaid at the expiration of the grace period, the Dental Assistant's certificate is cancelled. This cancellation will be published in the Bulletin of the MDA.
In order to re-register the Dental Assistant must apply in writing to the Board of the MDA for reinstatement. A reinstatement notice will be published once the Board directs the Registrar to reinstate the Dental Assistant's lapsed certificate.

Professional Liability Insurance
A Bylaw pursuant to Section 9 (1j.1) of The Dental Association Act relating to the professional liability coverage which a registered dental assistant of the Manitoba Dental Association must carry.
___________________________________________________________________________________________
1. Every dental assistant applying for a certificate of registration must carry a policy of professional liability insurance provided through the Canadian Dental Assistants Association, Insurance Broker - AON Reed, and Insurer - AVIVA in the amount of not less than $1,000,000.00 per claim.

A Bylaw to elect a dental assistant to serve on
The Manitoba Dental Association Board
According to The Dental Association Act article 6(3): At least one member of the Board must be a dental assistant.
1. Notice of Election
On or before the third Saturday in November, in each year the secretary shall send a notice in the form attached as Schedule "D" to this Bylaw to each dental assistant whose name appears in the Register of Dental Assistants who is of active status and in good standing on that date, advising that the dental assistant of the Board term of office will expire on January 31st of the following year. Such form shall include a nomination form for a dental assistant to fill the vacancy created by the expiry of the term.
2. Nominations
Every nomination for election to the Board under this Bylaw shall be in writing on the form set out in Schedule "D" and the consent of the person nominated shall be attached thereto or endorsed thereon.
3. Nominations Deadline
Every nomination of a candidate must be received by the secretary on or before the first Saturday in December otherwise it is invalid.
4. Eligibility
Every dental assistant whose name appears on the Register of Dental Assistants and who maintains a current registration of certificate and is in good standing is eligible to be nominated and vote
5. Acclamations
Where there is only one nomination for the position of dental assistant on the Board, the secretary shall on the first business day following the 10th day of December declare that the candidate so nominated elected as a member of the Board
6. Term of Office
The term of office for the elected individual is two years, starting at the annual meeting of the Association following the declaration of the election result
7. Mailing of Voting Papers
On or before the tenth day following the first Saturday in December, the secretary shall mail to every dental assistant in the Register of Dental Assistant and who maintains a current registration certificate and is in good standing on that date
a) a voting ballot in the form attached as schedule "E"
b) an envelope addressed to the secretary and clearly marked "voting envelope"
8. Appointment of Election Officials
In the absence of the secretary, the Registrar shall act in that capacity for election purposes only
9. Custody of Voting Papers and Counting of Ballots
The secretary shall safely keep, unopened, all voting envelopes received by him/her on or before noon on the thirty-first day of December from persons entitled to vote, and on the Monday following the first Saturday in January (hereinafter referred to as election day) at 5:00 p.m., in the presence of the scrutineers appointed by the candidates, if any, the secretary shall remove the voting papers from the voting envelopes and count only the unspoiled voting ballots.
10. Right to be Present
Any candidate is entitled to be present at the counting of the votes
11. Absence of Scrutineers
If no scrutineers are present the MDA President or in his/her absence the registrar, shall appoint two scrutineers
12. Procedure on Equality of Votes
If there is an equality of votes for two or more candidates after counting the ballots for a second time, as a result of which the election of one or more of such candidates is undecided the name of each such candidate shall be written upon a separate piece of paper and a scrutineer shall place the papers in a suitable receptacle, and the secretary shall draw at random therefrom, in the presence of the scrutineers, the number of papers equal to the number of dental assistants still to be elected, and the person or persons named upon the paper or papers so drawn shall be declared elected
13. Declaration of Voting Results
On completion of the counting of the votes the secretary shall forthwith declare the result of the election and certify it to the President, who shall announce the result to the President of the Manitoba Dental Assistants Association and at the annual meeting of the Association
14. Saving Provision
Any accidental failure on the part of the secretary to comply with any of the provisions of this Bylaw does not invalidate the election result.
15. Petition against Election
A petition against the election of the dental assistant(s) may be filed with the secretary by any dental assistant who lawfully voted at the election not later that fourteen days after the report of the President has been delivered in accordance with Section 13.
16. Contents of Petition
The petition shall contain a statement of the grounds on which the election is disputed, and no other grounds shall be considered on hearing of the petition.
17. Delivery of Petition
The petitioner shall, within 5 days of the filing of the petition, deliver a copy of it to the dental assistant whose election is disputed.
18. Time and Place of Hearing
On the filing of a petition the Board shall appoint a day, time and place for the hearing; and the secretary shall give notice thereof, in writing, to the petitioner and to the dental assistant whose election is disputed.
19. Committee to Hear Petition
The Board shall appoint a committee of dental assistants eligible to vote to hear the petition.
20. Report of Committee
After the hearing, the committee shall report to the Board, which thereupon shall consider the report and declare whether the dental assistant whose election is disputed was or was not duly elected.
21. Action When Election is Invalid
Where the Board declares that the dental assistant was not duly elected, it shall declare the office vacant and shall fill the same as provided in Section 25.
22. Taking Office
Subject to Section 23 the dental assistant so elected shall take office at the annual meeting following the election and shall hold office until their successor take office.
23. After the Election Petition
A dental assistant against whose election a petition has been filed as provided in Section 16 shall not take office until the Board declares that she/he has been duly elected.
24. Absence from Meetings
Where a member of the Board fails to attend 3 successive regular meetings of the Board she/he then ceases to be a member of the Board, unless she/he has been given leave of absence by the Board, or unless her/his failure to attend is excused by resolution of the Board.
25. Vacancy
In the case of the failure in any instance to elect the dental assistant board representative under this Bylaw, or in the case of a vacancy in the first year of a two year term and before the 26th day of November, however caused, the remaining members of the Board shall appoint a member at the next Board meeting to fill the vacancy until the next annual election when an election will be held to fill the vacancy for the remaining year of the term.

Peer Review Committee for Dental Assistants
A Bylaw to direct the timing and appointment of dental assistants to serve on Peer Review Committee for Dental Assistants as required by The Dental Association Act Section 24.2(3), 24.2(b) and 24.2(c):
Article 1
1. Annually at the first meeting of the Board, after the Annual Meeting of the Manitoba Dental Association, the Board shall appoint a Peer Review Committee in accordance with Section 24.3(3) of The Dental Association Act which consists of 12 dental assistants and 3 public representatives
2. Only dental assistants who are on the Register of Dental Assistants of active status and in good standing are eligible to serve on the Peer Review Committee for Dental Assistants
3. The public representatives are to be appointed by the Province of Manitoba
4. The Board may from time to time, appoint an additional dental assistant or dental assistants to fill vacancies on the Peer Review Committee occurring for any reason.
5. The Board shall appoint a dental assistant of the Peer Review Committee to be Chairperson or the Committee for such a period as the Board may determine.
6. A dental assistant who has served for three (3) consecutive years on the Peer Review Committee shall not be eligible for re-appointment until she/he has been off the Committee for at least one (1) year.
Article 2
1. The Peer Review Committee shall endeavour:
a. To ensure that the standard of dentistry practiced by dental assistants is such that the public can expect an acceptable level of competence from any dental assistant duly registered and in good standing with the Manitoba Dental Association
b. To promote public confidence in dental assistants
c. To encourage and promote ethical standards in and about the delivery of care by dental assistants
